Standard Terms & Conditions of Service
Package Fees/Deposit
Package Fees include expenses such as venue hire and styling and are non-refundable once a date has been set for your photoshoot experience. This is the policy of the venues we hire and the artists we use and is out of our control. The photographers fee of £99 is non refundable. If cancelled less than 14 days before the shoot you will need to pay £99 to rebook, prior to 14 days there will be a charge of 50% to re-book a second date.
Print Packages
Print packages must be paid for in full before your order will be sent to print. If you choose to pay monthly your order will go to print after receipt of your last payment and may take up to 8 weeks for delivery from this date.
Late Arrival
Any client arriving later than scheduled will have the time deducted from the remainder of their shoot. If you are late for your styling with the make-up and hair stylist they will charge you an additional hourly rate; which you must settle direct with them.
Conduct of the Shoot
The shoot will be arranged on date(s) mutually agreed between the parties. During the shoot the photographer will take into account the clients brief based on telephone and email interactions and the Pinterest board. Nude, Implied Nude and Topless imagery will only be undertaken if agreed and arranged prior to the shoot and will be photographed at the start of the session. You will be asked to have a photo taken in one of our branded t-shirts at the beginning with no make-up or hair styling for a before/after photo. You will be supplied with a dressing gown whilst changing and having your make-over applied, this must be returned at the end of the shoot.
Viewing & Sales Session
Your viewing and sales session will be arranged with you at the end of your photoshoot, in most circumstances your viewing appointment will be at the shoot location unless agreed otherwise. By the time of the viewing you should have made yourself familiar with the print products and price list, you will be able to order your products and pay via card during this session. There may not be samples available of all products due to transportation. Product creation can take anywhere between 2-8 weeks dependent on the product and whether it is being made in the UK or Italy. If you already know what products you would like to purchase please let us know and we will send you the relevant documentation.
Use of Imagery
You will sign a model release form before the photoshoot explaining how the images will be used. Unless you have signed a release form stating that we can share the imagery of you we will keep it confidential.
Artistic Right
The photographer retains the right of discretion in selecting the photographic materials released to the client; we will only show you the best images. Only edited images will be shown to the client. No unedited images will be shown or released to the client. The client will be able to view the final images during the viewing session for selection but these will not be available digitally or online. The photographer has the right to decline any requests by the client to edit any specifically requested images that the photographer deems not up to par with the rest of the work. The photographer has the right to decline any “extreme” editing requests, such as but not limited to background changes, added effects and body modifications. The photographer also retains the rights to make adjustments to the photographs in post-production as the photographer deems within their creative control.
Satisfaction & Accuracy
The client agrees that the work delivered will be of a similar style and caliber to those photographs on our website and social media platforms, and that the photographer will have complete creative control during the photographs and post-processing. The images will be delivered in a printed format to a high quality and colour corrected for the format they are being printed onto for optimum quality, colour and longevity. No re-editing will done once the images are presented to the client.
Social Media
The client may share web/blog posts through the direct link share options on the website. The client shall not copy, download, screenshot, or capture the photographs in any other fashion. If such actions the photographer reserves the right to request the photo(s) to be removed as they would no longer be accurate representations of the photographers work. When uploading to a Facebook or Instagram social media the client shall “tag” the photographers business in the album or photo of the uploaded file to give credit. There shall be no filter or any other kind of image manipulation added to the photo, as it would then be an incorrect representation of the artists work and potentially reflect poorly on the professional.
Exclusive Photographer & Approved Use
The Photographer shall be the exclusive photographer. It is understood that no other photographer may be appointed at the session while the Photographer is working. The client shall only use the photographic prints, in accordance with the permissions within this contract. The client’s prints are for personal use only and shall not be submitted to contests or reproduced for commercial use without written approval by the photographer. Prints should not be photographed or scanned for re-printing or sharing online, this is a breach of copyright and will not be representative of the photographers work, you may request a digital fie of a wall mounted print. Additional prints may be purchased between third parties and the Photographer with the permission of the client. If the photographer provides a digital file print release, the client must act in accordance with the release.
Limit of Liability
The Photographer limits any liability for the loss, damage or failure to produce photographs taken during the session. This includes equipment malfunction or loss, weather related issues, or failure or the client to show up to the session.
Copyright
Black Velvet Boudoir hereafter “Photographer”, owns the copyright to all images. All created photographs are protected by the European Union copyright laws. It is illegal to print, copy, scan, edit or reproduce photographs or digital images created without the written consent of the photographer. Fines will start at £100,000 for copyright infringement. The Photographer reserves the right to use photographs from your session for advertising, display, website promotion, photographic contests, publications, or any other purposes chosen by the Photographer upon signing of a release. The Photographer shall retain copyright ownership of all works created in the course of this contract, including but not limited to all images in their original and processed formats. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the photographer. Alterations include, but are not limited to, application of filters ,cropping, or modifications of any kind. If any of these actions are preformed the photographer reserves the right to contact you and request the photo(s) be removed as they would no longer be accurate representations of the photographers work.
Retention of Delivered Products & Files
Once the products are delivered to the client, it is the client’s sole responsibility to protect and retain their images for the future. We do not supply or offer digital products as technology can be fickle. One of the best ways to ensure the client’s images will last for generations is for the clients to print them, hence why we only offer printed products. If the client requires old files to be duplicated by the photographer, and they are still within the photographer’s possession, a restocking fee may be applied. The photographer only guarantees that the photographs will be available for up to three months after the viewing session, with a maximum archive of 2 years. After the three month mark the photographer no longer guarantees that the photographs will be available.
Print Release
The digital copies that the photographer may choose to release on purchasing of wall art will only be supplied in a small low resolution web ready format, this is typically 1280px wide at 72dpi in the sRGB colour space. The files will have embedded information that if you happen to take it to a printed they will request a Print Release from you to have it printed. We DO NOT provide Print Releases, we like to control the quality and printing of our work so that it is representative of the brands quality, if printed badly this will have a negative affect on our business. The file that is supplied to you is too small and in the incorrect colour space for printing, it will result in a pixellated image with a tonal range not as great as it should be.
